Basically, the data collected from the vehicles is sent to the car manufacturer and the latter, through the mobway platform, forwards the data to the application that the vehicle owner has consented to use.

The consent to send this data to the application used by the owner is given through an interface provided by mobway for the car manufacturer and/or service provider to collect the consent.

There are cases where the owner has consented to the sharing of his data with the car manufacturer when he purchased the vehicle.

In any case, mobway values transparency in the transmission and sharing of data and considers the express consent of the owner as the main legal basis for processing vehicle data.

what it means to be a personal data controller

According to the LGPD, a data controller is anyone who has the right to use personal data on the basis of the data subject's consent or another legal basis.

A data processor is a person who processes personal data on behalf of the controller, i.e. the controller can ask a third party to process the data he is entitled to use.

is the data collected from vehicles personal?

As a rule, the data shared with mobway about the use of vehicles does not include personal data. However, when associated with geolocation data and chassis numbers, this data can allow the owner to be identified and is therefore considered personal data.

Despite this, in the flow proposed by mobway, the car manufacturer and the service provider will be the only ones able to identify the owner of the vehicle. The mobway will interface between them via a unique identifier that will enable end-to-end data transmission.

mobway only accesses personal data in accordance with the law and respecting the individual rights of the data subjects.
